La prochaine Validation du Cameroun sur la base de la Norme ITIE 2019 commencera le 1er octobre 2023.
Conformément à la procédure de Validation, le Secrétariat international de l’ITIE cherche à collecter les points de vue des parties prenantes sur les progrès accomplis au Cameroun dans la mise en œuvre de la Norme ITIE entre janvier 2021 et octobre 2023.

DOUBLE SESSION DU COMITE ITIE DES 17 ET 18 AOUT 2023
Accélérer le niveau de mise en œuvre des recommandations de la nouvelle validation
Réuni au cours des sessions des 17 et 18 août 2023 autour du Ministre des Mines, de l’Industrie et du Développement Technologique, Vice-président du Comité ITIE, Monsieur FUH Calistus Gentry, les membres de ladite institution étaient appelés à délibérer sur l’ordre du jour ci –après :
Examen en vue adoption des projets de comptes rendus des sessions des 04, 05 et 18 avril 2023, des 01 et 02 juin 2023;
Examen en vue adoption des Termes de Référence du marché de conciliation ITIE des exercices 2020 et 2021 à titre de régularisation;
Thème de la présentation du jour « valeur ajoutée des institutions de contrôle dans la mission des Comités ITIE, à l’aune de la nouvelle Norme ITIE : éléments d’analyse et de prospective » ;
Examen en vue adoption des rapports annuels d’avancement des exercices 2021 et 2022 ;
Examen du projet de révision de décret ITIE 2018 ;
Divers.
Dès l’entame des travaux, le Ministre des Mines a rappelé aux participants que l’essentiel des points inscrits à l’ordre du jour, d’une part, participe directement à la préparation de la nouvelle validation du Cameroun qui débutera le 1er octobre 2023, et d’autre part, vise à arrimer le pays à la Norme ITIE 2023 en envisageant une coopération future entre le Comité ITIE et les Institutions Supérieures de Contrôle (Chambres des Comptes, CONSUPE).
L’un des points d’orgue desdites séances a porté sur la discussion concernant le décret ITIE en cours de modification. Les débats ont non seulement permis de réaffirmer la ferme volonté de l’Etat du Cameroun de demeurer pays membre de l’Initiative mais surtout d’attester de l’engagement des autorités en charge de l’ITIE de tout mettre en œuvre pour faire de cette institution, une organisation avant-gardiste. Les questions de statut juridique, d’indépendance des principaux collèges, d’effectivité du Secrétariat Permanent, de pérennisation du financement de l’institution, ont été au menu des échanges. Dans l’ensemble, les discussions ont été franches et constructives entre les membres des différents collèges siégeant au Comité.
Au terme desdites sessions, le Comité a décidé:
D’adopter les comptes rendus des sessions des 04, 05 et 18 avril 2023 ainsi que ceux des 01 et 02 juin 2023;
D’adopter les termes de référence du marché de conciliation ITIE des exercices 2020 et 2021 à titre de régularisation sous réserve de la prise en compte des contributions pertinentes formulées par les membres;
De renvoyer l’adoption des rapports annuels d’avancement à une prochaine séance pour complément d’informations;
D’intégrer dans le groupe Ad Hoc mis en place pour la rédaction du projet de révision du décret ITIE 2018, des experts légistes et traducteurs en langue anglaise.
DOUBLE SESSION OF THE EITI COMMITTEE OF AUGUST 17 AND 18, 2023
Accelerate the level of implementation of the recommendations of the new validation
Reunited during the sessions of August 17 and 18, 2023 around the Minister of Mining, Industry and Technological Development, Vice-Chairman of the EITI Committee, Mr FUH Calistus Gentry, the members of the said institution were called upon to deliberate on the agenda below:
To start the said sessions, the Minister of Mines reminded the participants that most of the points on the agenda, on the one hand, directly contribute to the preparation of the new validation of Cameroon which will begin on October 1, 2023, and on the other hand, aims to align the country with the 2023 EITI Standard by considering future cooperation between the EITI Committee and the Supreme Audit Institutions (Chambers of Accounts, supreme audit Ministry).
One of the high points of these sessions focused on the discussion concerning the EITI decree currently being amended. The debates were made to reaffirm the firm will of the State of Cameroon to remain a member country of the Initiative and to attest the commitment of EITI authorities to do everything possible to make this institution, a forward-thinking organization. The questions of legal status, independence of the main stakeholders, effectiveness of the Permanent Secretariat, sustainability of the institution’s financing, were on the menu of discussions. On the whole, the discussions were frank and constructive between the members of the different constituencies sitting on the Committee.
At the end of the said sessions, the Committee decided:
1. To adopt the minutes of April 04, 05 and 18, 2023 as well as those of June 01 and 02, 2023 sessions;
2. To adopt the terms of reference of the EITI reconciliation market for the 2020 and 2021 financial years as a regularization subject to taking into account the relevant contributions made by the members;
3. To postpone the adoption of the annual progress reports in order to complete additional information;
4. To integrate into the Ad Hoc group set up for the drafting revision of the 2018 EITI decree, legal experts and translators in English.
“The EITI Committee intends to publish for the first time in the 2021 EITI Report, the beneficial owners of all extractive companies”, it is with these words that the Minister of Mining, Professor Fuh Calistus GENTRY opened the workshop chaired by him at the Mont Fébé hotel in Yaoundé, on August 10, 2023. The Acting Minister of Mining took the opportunity to raise awareness among participants of their obligation under the 2023 Finance Law, to declare the beneficial owners. He recalled that any contravener of this obligation would be exposed to the rigor of the provisions of the General Tax Code in its article L8 quinquies.
Provided by requirement 2.5 of the EITI Standard, the purpose of the beneficial ownership statement is to disclose the individuals who ultimately control the companies applying for or holding title to operate in the extractive sector under the EITI Standard. law or convention.
With regard to the said theme, Cameroon, whose new validation at the EITI will begin on October 1, 2023, is making progress relating to the obligation to disclose beneficial ownership. It is more than in the past for the country to create a reliable and transparent business environment in order to strengthen the fight against illicit financial flows (corruption, money laundering, etc.).
This workshop was attended by members of the Interministerial Committee in charge of the evaluation of Cameroon by the peers of the global forum placed with the General Directorate of Taxation, focal points of the administrations supplying EITI data, companies selected in the unilateral declaration of the Directorate General of Taxation as well as all the permanent staff including the Permanent Secretary.
The meeting began with a protocol phase punctuated by speeches and family pictures. Then, took place the training phase through a videoconference led by Mr. Radouane BOUZAIANE of the ENERTEAM firm, recruited by the State as Independent Administrator to draft the 17th EITI Report. The publication of that report is scheduled for mid – September 2023. In his presentation, the Independent Administrator highlight the definition of the beneficial owner, the 5% reporting threshold adopted by the EITI Committee, the forms of direct and indirect control of capital, the methods of identifying the beneficial owner, typology of companies reporting beneficial ownership, politically exposed persons disclosure criteria, reporting instructions and timeline. At the end of his presentation, he recalled deadlines for submitting:

The duly signed and then certified versions of the said forms must be sent no later than August 21, 2023 in hard copy. These should be sent to the Permanent Secretariat of the EITI Committee, BP 11 063 Yaoundé, ninth floor of the SNI building.
Before closing the workshop, the Independent Conciliator responded to the main concerns of the participants, which essentially related to the clarifications concerning: the assurance and reliability of the information disclosed in the declaration of beneficial owners of companies, the type of the companies concerned by the said declaration, the identification of the beneficial owner, the methods of disclosure of the beneficial owners, the capital structure of the companies in the mining, oil and gas sectors, the incidence of double voting right, etc.

« Le Comité ITIE entend publier pour la première fois dans le Rapport ITIE 2021, les bénéficiaires effectifs de toutes les entreprises extractives », c’est par ces mots que le Ministre en charge des Mines, Professeur Fuh Calistus GENTRY a ouvert l’atelier qu’il a présidé à l’hôtel Mont Fébé de Yaoundé, le 10 août 2023. Le Ministre des Mines par intérim a saisi l’occasion pour sensibiliser les participants sur l’obligation qui leur incombe en vertu de la Loi des Finances 2023, de déclarer les bénéficiaires effectifs. Il a rappelé que tout contrevenant à cette obligation s’exposerait à la rigueur des dispositions du Code Général des Impôts en son article L8 quinquies.
Prévue par l’exigence 2.5 de la Norme ITIE, le but de la déclaration du bénéficiaire effectif est de dévoiler les personnes physiques qui contrôlent en dernier ressort les entreprises qui font la demande ou détiennent des titres pour opérer dans le secteur extractif en vertu de la Loi ou de la convention.
S’agissant de ladite thématique, le Cameroun dont la nouvelle validation à l’ITIE va débuter le 1er octobre 2023, enregistre des avancées tenant à l’obligation de divulguer la propriété effective. Il s’agit plus que par le passé pour le pays de créer un environnement des affaires fiable et transparent en vue de renforcer la lutte contre les flux financiers illicites (corruption, blanchiment, etc.).
Ledit atelier très couru, a connu la participation des membres du Comité Interministériel chargé de l’évaluation du Cameroun par les pairs du forum mondial placé auprès de la Direction Générale des Impôts, des points focaux des administrations fournisseuses des données ITIE, des entreprises retenues dans la déclaration unilatérale de la Direction Générale des Impôts ainsi que l’ensemble des personnels permanents dont le Secrétaire Permanent.
La rencontre a débuté par une phase protocolaire ponctuée de discours et de photo de famille. Ensuite, la phase de formation proprement dite s’est déroulée par le canal d’une visioconférence animée par monsieur Radouane BOUZAIANE du Cabinet ENERTEAM, recruté par l’Etat comme Administrateur Indépendant pour rédiger le 17ème Rapport ITIE dont la publication est prévue pour la mi- septembre 2023. Dans sa présentation, l’Administrateur Indépendant est revenu sur la définition du bénéficiaire effectif, le seuil de déclaration de 5% adopté par le Comité ITIE, les formes de contrôles directes et indirectes du capital, les techniques d’identification du bénéficiaire effectif, la typologie des entreprises déclarant la propriété effective, les critères de divulgation des personnes politiquement exposées, les instructions de reporting et le calendrier. A la fin de son exposé, Il a communiqué des dates limites pour soumettre :

Les versions desdits formulaires dument signées puis certifiées doivent être envoyées au plus tard le 21 août 2023 en version papier. Celles-ci doivent être acheminées au Secrétariat Permanent du Comité ITIE, BP 11 063 Yaoundé, neuvième étage de l’immeuble SNI.
Avant de clore l’atelier, l’Administrateur Indépendant a répondu aux principales préoccupations des participants qui pour l’essentiel ont porté sur les clarifications concernant: l’assurance et la fiabilité des informations dévoilées dans la déclaration de bénéficiaires effectifs des entreprises, le type des entreprises concernées par ladite déclaration, l’identification du bénéficiaire effectif, les modalités de divulgation des bénéficiaires effectifs, la structure du capital des entreprises des secteurs minier, pétrolier et gazier, l’incidence du droit de vote double, etc.
